Terms of Service

These Terms of Service (“Terms”) govern your access to and use of cogentichq.com (the “Site”), operated by Cogentic, Inc. (“Cogentic,” “we,” “us”). By using the Site you agree to these Terms. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization.

The Site describes the Cogentic software product. Use of the software itself, including pilots, assessments, and production deployments, is governed exclusively by a separate written agreement between Cogentic and the customer. Nothing on the Site grants a license to the software, and product descriptions, illustrative figures, and demonstrations on the Site do not form part of any contract.

You may not use the Site to violate any law; attempt to probe, scan, or breach security measures beyond the coordinated disclosure process described in /.well-known/security.txt; scrape at volumes that degrade the Site; misrepresent your affiliation; or infringe the rights of others.

The Site and its contents, including text, design, graphics, product interfaces shown in demonstrations, and the Cogentic name and marks, are owned by Cogentic or its licensors and are protected by intellectual-property laws. You may view and share links to the Site; any other use requires our prior written consent.

Site content is provided for general information about our product. Figures described as illustrative, representative, or drawn from published industry research are exactly that, and actual results depend on each customer’s data and environment. THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COGENTIC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS. Liability relating to the software product is addressed solely in the applicable customer agreement.

The Site may link to third-party services, such as scheduling tools. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

We may update the Site and these Terms from time to time. Material changes will be reflected by a revised effective date on this page. Continued use of the Site after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
